These terms mainly constitute the content of the contract concerning the use of Spots between Guests and Hosts. For contractual relationships between a Guest or a Host and PITLAB Co., Ltd. (hereinafter "PITLAB"), please refer to the PraySpot Terms of Use and the PraySpot Host Terms of Use.
Article 1 Application
- Unless otherwise provided in these PraySpot Guest Terms of Use (hereinafter "these Terms"), the terms used herein and the clauses applicable to the use of the Service shall be governed by the PraySpot Terms of Use and the PraySpot Host Terms of Use.
- If, prior to the formation of an Individual Contract (see Article 8 of the PraySpot Terms of Use; hereinafter the same), the Host separately presents house rules or other terms of use, such rules shall, in addition to these Terms, constitute part of the Individual Contract between the Guest and the Host. In the event of any conflict between these Terms and such rules, the latter shall prevail.
Article 2 Amendment of Terms
- PITLAB may modify the content of these Terms when it deems such modification necessary.
- When modifying these Terms, PITLAB will announce in advance the content of the amended Terms and the effective date thereof by posting on the Service website or by any other method that PITLAB considers appropriate. However, if obtaining the Guest's consent is required by law, PITLAB shall obtain such consent by a method it considers appropriate. Unless otherwise invalidated by law, a Guest shall be deemed to have agreed to the amended Terms if the Guest uses the Service after the effective date specified in the notice.
Article 3 Notice
- When PITLAB gives notice to a Guest in relation to the Service, PITLAB shall do so by any method it deems appropriate, such as posting on the Service or sending an e-mail or document to the e-mail address or postal address registered by the Guest.
- Even if an e-mail sent to the e-mail address registered by the Guest results in an error for any reason, the notice shall be deemed to have been given, and PITLAB may cease delivery to that address. PITLAB shall not be liable for any damage incurred by the Guest due to the Guest's inability to receive e-mails or due to such suspension of delivery.
Article 4 Registration
- A person wishing to register as a Guest of the Service (hereinafter "Guest Applicant") may apply to PITLAB for Guest registration by providing the information prescribed by PITLAB (hereinafter "Guest Registration Information") in the manner designated by PITLAB, after agreeing to comply with these Terms.
- The application for registration must be made by the individual or corporation who will use the Service. The Guest Applicant shall provide PITLAB with true, accurate and up‑to‑date information at the time of application.
- PITLAB shall, at its sole discretion, determine whether or not to approve the Guest Applicant's registration and, if approved, shall notify the Guest Applicant thereof. Upon such notice, the registration as a Guest shall be completed. Upon completion of registration, a Service Use Agreement based on PITLAB's various terms (see Article 2, item 12 of the PraySpot Terms of Use) shall be formed between PITLAB and the Guest, and the Guest may use the Service in the manner prescribed by PITLAB.
- PITLAB may refuse registration if the Guest Applicant falls under any of the following:
(1). PITLAB determines that the applicant may violate PITLAB's various terms
(2). Any false, incorrect or omitted information is included in the registration information provided
(3). The applicant is the same as, or is reasonably deemed to be the same as, a person whose registration has been cancelled in the past
(4). The applicant is a minor, adult ward, person under curatorship or person under assistance and has not obtained the proper consent of their statutory agent, guardian, curator or assistant
(5). The applicant is, or is determined by PITLAB or a third party to be, an antisocial force or involved in the maintenance, operation or management thereof through funding or other means
(6). PITLAB determines that the applicant may engage in acts that hinder the proper operation or provision of the Service
(7). PITLAB otherwise deems the registration inappropriate
Article 5 Conditions of Use
- Spots are provided on an \"as‑is\" basis. Please inspect and confirm the Spot before making a reservation; no objections may be raised regarding its current condition for any reason.
- When using the Spot and its ancillary facilities, handle them with the care of a prudent manager.
- If the Guest breaches these Terms or the house rules presented by the Host and thereby uses, consumes, damages, or loses any buildings, facilities, fixtures, or equipment attached to the Spot, causing damage to the Host, the Guest shall compensate for such damage, including the actual repair costs and loss of profit due to the Spot becoming unusable. Repairs shall be arranged and carried out by the Host, who may invoice the Guest for the actual costs. The Guest shall not object or make any claims against the Host or PITLAB.
- The Host and PITLAB assume no liability for any personal injury, theft, damage, or any other accidents arising from the use of the Spot.
- The management of any equipment, goods, exhibits, etc. brought into the Spot by the Guest shall be at the Guest's own responsibility, and the Host and PITLAB shall bear no responsibility for theft, loss, fire, or other damages.
- No discounts or refunds will be made even if the Guest leaves before the end of the contracted period.
- If payment of the Spot usage fee is not confirmed by the payment deadline, a default interest of 14.6% per annum may accrue from the day following such deadline until payment is made.
- After the end of the usage period, the Guest may not enter the Spot without prior consent of the Host and PITLAB.
- Displayed Spot usage fees and maintenance fees do not include consumption tax.
- In the case of unauthorized use without reservation or use beyond the reserved time without the Host's consent, JPY 10,000 (or the amount separately set by the Host) will be charged.
- Extension of the reservation time is not allowed without the Host's consent.
- Any luggage, equipment, etc. not removed by the end of use shall be deemed abandoned by the Guest and may be carried, moved, disposed of, or discarded by the Host. The Guest shall bear the actual costs (transportation, cleaning, disposal, etc.) incurred and agrees not to object.
- If the Guest has not vacated the Spot after the end time, a late fee of JPY 10,000 per day (or an amount specified by the Host) will be charged, including the days required for restoration to original condition.
- For Spots with keys, please promptly return the key in the manner specified by the Host at the end of the usage period.
- For security purposes, some Spots are equipped with surveillance cameras. Please be aware in advance.
- Reserved Spots may only be used by the Guest, the accompanying group, or members of the organization to which the Guest belongs. Transfer or sublease to third parties without permission from the Host and PITLAB is prohibited.
- If the Guest violates PITLAB's various terms or the conditions presented by the Host, and such violations reach the number of times stipulated by PITLAB, PITLAB may, without prior notice, suspend or delete the account of the Guest. PITLAB shall not be liable for any damages incurred by the Guest as a result of such measures.
Article 6 Disclaimer
- The Guest agrees in advance that PITLAB shall not be liable for any damages arising from any of the following:
(1). Damages arising from cancellation of reservations or applications, or changes in schedule or content
(2). Damages arising from fraudulent use, property damage, unauthorized cancellation, theft, accident, malfunction, fire, disaster, infectious disease, leakage, or other troubles occurring within the Spot or the facility/building in which the Spot is located
(3). Damages such as business compensation, transportation costs, or labor costs incurred when the Guest is unable to use the Spot on the reserved day or ceases use midway
(4). Damages caused by the Guest to the Host, other Guests, or third parties in connection with the use of the Service, or damages resulting from the Guest's own negligence (e.g., self‑inflicted accidents)
(5). Any damages arising from the Guest's violation of these Terms, the PlaySpot Host Terms, the Guest Terms, or the cancellation policy and notes on each reservation page
- If the contract between the Guest and the Host constitutes a “Consumer Contract” under the Consumer Contract Act of Japan, any provision in this Article that completely exempts the Host from liability shall not apply. In such case, unless the Host has acted intentionally or with gross negligence, the Host's liability for damages to the Guest shall be limited to the amount of the Spot usage fee paid by the Guest for the relevant Spot usage.
Article 7 Restrictions on Use
In the following cases, or when any of the following circumstances arises, reservation applications for the Spot by the Guest or a group to which the Guest belongs may be refused. Even if a reservation has been established, PITLAB and the Host may take measures such as refusing, suspending, or canceling use. PITLAB and the Host shall not be liable for any damages incurred by the Guest as a result of such measures.
(1). The Guest is, or is recognized as, an organized crime group, organized crime group‑related company/organization, corporate extortionist, extremist group, or other antisocial force (collectively "Antisocial Force, etc.") or its related person (including the case where a third party certifies such fact)
(2). An Antisocial Force, etc. or its related person is recognized to control the business activities of the corporation or other organization to which the Guest belongs
(3). Officers, employees, or related persons of the Guest are Antisocial Forces, etc. or their related persons
(4). The Guest engages in conduct that causes significant nuisance or anxiety to other users of the Host
(5). The Guest engages in violence, threats, intimidation, blackmail, coercive demands, or demands exceeding reasonable bounds against the Host or PITLAB, or has done so in the past
(6). PITLAB or the Host determines that the Guest may engage in acts that violate laws, regulations, public order, or guidelines established by PITLAB
(7). The Guest is clearly infected with an infectious or contagious disease and is deemed likely to affect other users
(8). The Spot is fully booked or otherwise unavailable because of overcapacity or full occupancy
(9). PITLAB or the Host determines that the Spot cannot be provided due to natural disasters such as earthquake, typhoon, fire, power outage, facility failure, or other unavoidable circumstances
(10). Use is prohibited or restricted by local ordinances, laws, or regulations in the area where the Spot is located
Article 8 Suspension of Use
Even after a reservation has been established or during use, if PITLAB or the Host determines that the Guest falls under any of the following, the Guest may be required to suspend use of the Spot. If PITLAB requests an explanation regarding the applicability of any of these items and does not receive a reasonable explanation within the period prescribed by PITLAB, PITLAB may deem that such conduct has occurred.
(1). The actual use significantly differs from the purpose or event content presented at the time of application or from submitted materials
(2). The Guest causes significant nuisance to other Spot users or related business operators
(3). The Guest subleases the Spot to a third party without the permission of the Host or PITLAB
(4). PITLAB or the Host determines that use of the Spot is inappropriate for public morals or safety management reasons
(5). The Guest brings or uses goods/equipment that are beyond common sense
(6). Government agencies issue an order to suspend use of the Spot
(7). The Guest violates the PlaySpot Host Terms, Guest Terms, these Terms, prohibited matters or notes established by PITLAB, or instructions from the Host
(8). The Guest is, or is deemed likely to be, an Antisocial Force, etc. or its related person
(9). The Guest is deemed likely to engage in acts that violate laws, regulations, public order, or good morals
(10). The Guest is clearly infected with an infectious or contagious disease
(11). Use of the Spot becomes difficult due to natural disasters, equipment failure, or other unavoidable reasons
(12). Use violates local ordinances or rules in the area where the Spot is located
(13). PITLAB or the Host otherwise determines that the use is socially inappropriate
Even if use is suspended under this Article, Spot usage fees already paid will not be refunded. The Guest shall compensate for any damages arising from such suspension at the Guest's responsibility.
Article 9 Prohibited Acts
When using the Spot, the Guest shall not engage in any of the following acts. If PITLAB or the Host determines that the Guest falls under or is likely to fall under any of the following acts, PITLAB or the Host may take measures such as stopping the use of the Spot, canceling the reservation, claiming damages, or suspending the account.
(1). Acts that violate laws such as the Penal Code or Copyright Act, ordinances established by local governments, or other regulations, or acts that are likely to do so
(2). Sale, display, or distribution of products whose sale or supply is prohibited by law
(3). Acts that are offensive to public order and morals, or indecent or obscene displays, sales, or other acts
(4). Acts that generate noise, vibration, odors, etc., causing nuisance to the Host, other Guests, or building tenants
(5). Bringing in or selling animals/pets, dangerous goods, or large‑scale equipment beyond common sense (except where the Host has given prior consent)
(6). Use for purposes or content different from that declared at the time of application
(7). Exhibition, sale, or distribution of items that may infringe on another person's intellectual property rights, portrait rights, privacy, honor, or other rights or interests
(8). Acts that alter the floor, walls, ceilings, fixtures, equipment, etc., such as nailing, attaching adhesive tape or tacks, redecorating, remodeling, or any other acts that change the current state without the Host's consent
(9). Acts that cause disadvantage to PITLAB or the Host (including, but not limited to, use outside reserved hours, damage to equipment, unauthorized extension, etc.)
(10). Acts that may lead to direct negotiation/contract with the Host without PITLAB's permission (e.g., inducing direct reservation outside PlaySpot)
(11). Transferring or subleasing all or part of the right to use the Spot to a third party without the Host's prior written consent
(12). Expanding, renovating, modifying, relocating, remodeling, or installing structures on the premises without the Host's prior written consent
(13). Other acts prohibited by laws or ordinances or acts that PITLAB deems socially inappropriate
Supplementary Provisions
Enacted and enforced on April 1, 2025
The original text of these Terms is written in Japanese. In case of any discrepancy between the translation and the Japanese version, the Japanese version shall prevail.
